What is a Lasting Power of Attorney?

A Lasting Power of Attorney (LPA) is a legal document that allows you (the donor) to appoint one or more individuals (your attorneys) to assist you in making decisions or to make decisions on your behalf if you lose mental capacity.

It offers peace of mind that your financial, health, and personal affairs will be managed according to your wishes, reducing the burden on loved ones and avoiding legal complications should you become unable to make decisions for yourself.

What are the different types of LPAs?

There are two key types, each addressing different aspects of your life and well-being:-

Property & Financial Affairs LPA: Management of financial matters and property.

This type of LPA allows decisions about the donor's property and financial
matters to be made. It can be used as soon as it's registered, with the donor's
consent. This is particularly useful if the donor has or develops mobility
issues, as well as if they lose capacity. The attorney can:

  • Manage the donor's bank accounts.
  • Pay bills and collect benefits or pensions.
  • Make or sell investments.
  • Buy or sell property on behalf of the donor.
  • Handle tax affairs and other financial transactions.

Health and Welfare LPA: Decisions about medical care and living arrangements.

This type of LPA covers decisions about the donor's personal welfare and health. It can only be used when the donor has lost the capacity to make decisions. The attorney will be able to:

  • Decide where the donor lives and oversee day-to-day care.
  • Arrange medical, dental, and optical care.
  • Consent to or refuse medical treatment, including life-sustaining treatment,
    as specified in the LPA.
  • Make decisions about the donor's diet, clothing, and exercise.
  • Control Over Decisions:

    An LPA allows you to choose trusted individuals (attorneys) to make decisions on your behalf, ensuring someone you trust is managing your affairs.

  • Flexibility and Tailoring:

    You can outline specific instructions and preferences in the LPA, enabling your attorneys to make decisions that align closely with your wishes. This ensures that your personal values and choices are respected at all times.
